Terms of Service

These Terms govern your use of Then What?, including the mobile app and thenwhat.ch (the “Service”), operated by AlterAspect LLC (“we,” “our,” or “us”). By using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 13 years old to use the Service and meet any additional age requirements that apply where you live. If you are not legally able to agree to these Terms on your own, your parent or guardian must agree on your behalf. You are responsible for the accuracy of your account information, the security of your account, and activity under your account.

2. Credits and purchases

AI generation features may require credits. Available products, prices, renewal periods, credit allocations, and usage costs are shown in the app before purchase or use. Credit usage varies with the operation requested.

App Store purchases are charged to your Apple account. Subscriptions automatically renew unless canceled at least 24 hours before the current period ends. Your account may be charged for renewal within 24 hours before that period ends. You can manage or cancel subscriptions in your Apple account settings.

Subscription credits refresh according to the plan shown in the app and do not roll over. Purchased credit packs add to your credit balance and do not expire. Credits have no cash value and cannot be transferred or redeemed for money. Refunds are handled under Apple’s policies and applicable law.

3. Your content and community stories

You retain the rights you hold in content you submit. You are responsible for having the rights and permissions needed to upload that content and authorize its use, including permission to use identifiable people’s likenesses or voices.

You grant us a non-exclusive, worldwide license to store, process, display, and distribute your content as necessary to operate the Service. When you publish or contribute to a shared story, you authorize its display within that story and its use in community continuations through the Service. Other users may view and build on shared stories.

4. Acceptable use

You must not use the Service to:

  • Create or distribute illegal, abusive, exploitative, or otherwise harmful content.
  • Infringe others’ intellectual property, privacy, or other rights.
  • Harass, threaten, impersonate, or deceive other people.
  • Evade billing, credit limits, access restrictions, or safety measures.
  • Interfere with the Service or access it through unauthorized automated tools.

We may remove content or suspend access when these Terms are violated. You can report content or a safety concern through available in-app controls or by contacting contact@thenwhat.ch.

5. AI-generated content

AI features process prompts, selected references, uploaded media, and relevant story context using third-party providers. See our Privacy Policy for how information is handled.

AI output can be inaccurate, unexpected, or similar to output received by others. We do not guarantee its accuracy, originality, suitability, or eligibility for intellectual property protection. You are responsible for reviewing generated content before using or sharing it.

6. Our intellectual property

The Service’s software, design, and branding belong to AlterAspect LLC or its licensors and are protected by applicable law. These Terms do not transfer ownership of the Service to you.

7. Availability and disclaimers

To the extent permitted by law, the Service and generated content are provided “as is” and “as available,” without warranties of any kind. We do not guarantee uninterrupted or error-free service. Features may change as the Service develops.

8. Limitation of liability

To the maximum extent permitted by law, AlterAspect LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.

9. Ending your use

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access for violations of these Terms. Deleting your account does not automatically cancel an App Store subscription; manage it separately through Apple.

10. Changes and governing law

We may update these Terms and will notify you of material changes through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms. These Terms are governed by California law, without regard to its conflict-of-law rules, subject to any mandatory protections that apply where you live.
